Communities affected by human rights violations and atrocity crimes in Syria have no access to effective remedy in Syria, where displacement, ongoing conflict, violations in the justice system, and other circumstances limit victims’ ability to recover from the violations they have suffered. In addition, procedural, jurisdictional, and logistical hurdles prevent victims and survivors from accessing the reparative and remedial measures they are owed through foreign jurisdictions.

To address these obstacles, the Strategic Litigation Project (SLP) is working with Syrian civil society to explore and advocate for the establishment of an intergovernmental Syria Victims Fund. Developed through ongoing consultations with Syrian civil society, the suggested framework for the Fund would rely on significant monetary judgments that States are collecting linked to violations in Syria—including fines, penalties, and forfeitures for sanctions violations and international crimes committed in Syria. The concept for a Syria Victims Fund proposes that States deposit these Syria-linked funds into a central location and direct them to better support victims of international law violations in Syria, rather than retaining those funds and essentially profiting from violations in Syria.
